Terms of Service

1. Agreement to Terms

By downloading, accessing, or using the Nudge app and website (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes your acceptance of the new terms.

2. Use License

Nudge grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not:

  • Modify, distribute, or reverse-engineer the app or its code
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Harass, abuse, or threaten other users in body doubling rooms or elsewhere
  • Spam or send unsolicited communications through the Service
  • Scrape, crawl, or automatically collect data without permission

3. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your password and account
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access
  • Using the Service in compliance with all applicable laws

4. Acceptable Use

You agree not to use Nudge to:

  • Engage in self-harm or suicide-related activity (our app has crisis resources)
  • Harass, bully, or threaten other users
  • Transmit viruses, malware, or harmful code
  • Impersonate others or misrepresent your identity
  • Violate any laws or third-party rights
  • Access or use the Service with automated bots (except authorized integrations)

5. Subscriptions & Billing

Free Trial: New users receive a 7-day free trial with full access. No credit card required.

Paid Plans: After trial expiration, you may subscribe to Annual or Lifetime plans. Billing is handled through Apple App Store, Google Play Store, or RevenueCat.

  • Annual Plan: Auto-renews yearly unless cancelled before renewal date
  • Lifetime Plan: One-time purchase with no recurring charges
  • Refunds: Follow App Store / Play Store refund policies (typically 48 hours for accidental purchases)
  • Cancellation: You may cancel Annual subscriptions anytime. Lifetime purchases are non-refundable

6. Intellectual Property

Nudge and all its content (design, code, text, graphics) are owned by Nudge or licensed to us. You retain ownership of the tasks and data you create, but grant us a license to use your data to provide and improve the Service.

You may not copy, distribute, or resell the Service without explicit permission.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • Nudge is provided "as is" without warranties of any kind, express or implied
  • We are not liable for lost data, lost productivity, or indirect damages
  • Our total liability is limited to the amount you paid for the Service in the past 12 months
  • We are not responsible for service interruptions, bugs, or data loss due to circumstances beyond our control

Exception: This does not limit liability for death, personal injury, fraud, or gross negligence.

No Guarantee of Productivity: While Nudge is designed to help with task management and focus, results vary by individual. We do not guarantee that using Nudge will improve your productivity.

9. Indemnification

You agree to indemnify and hold harmless Nudge from any claims, damages, or costs (including legal fees) arising from your use of the Service, violation of these terms, or violation of any laws.

10. Termination

We may terminate or suspend your account if you:

  • Violate these Terms of Service
  • Engage in illegal activity
  • Harass or threaten other users
  • Attempt to gain unauthorized access to the Service

Termination may result in loss of access to your account and data (though you may request data export before deletion).

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflicts of law principles.
